O R D E R

% 05.05.2017 This writ petition claims to have been filed in public interest makes allegations regarding corruption against the National Institute of Technology (NIT), Uttrakhand.

We are informed by Mr.Sanjay Jain, learned ASG appearing for R1 and R-2 that the Department of Higher Education under Ministry of Human Resources and Development, the Government of India has undertaken inquiries into the force of the allegations of illegal purchase of Lab-view equipments for the laboratory by order dated 27th December, 2016.

Allegations of corruption against Director and Assistant Professor

in the NIT has been examined by the Central Bureau of Investigation which has submitted a self contained note under the cover of a communication dated 24th September, 2015 forwarded to the Chief Vigilance Officer of the Ministry of Human Resources and Development. Mr.Sanjay Jain, learned ASG has further handed over a copy of the letter dated 27th December, 2016 addressed by the Department of Higher Education and the Ministry of Human Resources Development of the Government of India forwarding self contained note of CBI to the concerned disciplinary authorities with the direction that after their examination, the matter may be sent to the Central Vigilance Commissioner for the first stage advice. The format of first stage advice has also been enclosed therewith.

In view of the above, we find that all the above actions have been completed way back in the year 2016 itself. The present writ petition which has been filed on 21st March, 2017 has, therefore, been filed without undertaking any enquiry with regard to the subject matter thereof. The writ claims to have been filed in public interest is clearly inappropriate and misconceived and warrants no action at all. The writ petition is therefore dismissed.
