Through the instant petition under Article 226 of the Constitution of India, read with Section 482 of the Code of Criminal Procedure, 19731, the Petitioners seek directions to the Respondent No. 1 to provide them with police protection in light of alleged threats made by Respondents No. 2, 3, 4 and 5.

Petitioner No. 1 submits that she is a major who has consensually married Petitioner No. 2 as per Hindu rights and customs on 25th September, 2023. She places reliance on her certificate of elementary education as proof of date of birth. She further submits that after her marriage, she informed her 1 "CrPC"

mother and sister over a phone call that she had married Petitioner No. 2 voluntarily and that she wishes to live with him and does not want to return to her parental home. She contends that instead of accepting her decision, her parents filed a missing persons complaint to the police, due to which the police officials harassed the family members of the Petitioner's in-laws. 3.

Pertinently, she alleges that while she has been residing with her husband and in-laws, her parents have been repeatedly harassing her to leave them and return to her parental home. She further alleges that for this reason, her family members, respondents No. 2 to 5 have been threatening her and her husband's life. Therefore, having reasonable apprehension that there is a threat to their life and liberty, the Petitioners have invoked the jurisdiction of this Court under Article 226 of the Constitution of India seeking the following reliefs:

To direct the SHO, P.S. GANDHI NAGAR or DCP North East District to provide protection to the petitioner and her husband against the threat of the respondent No.2, 3, 4 and 5. b.

To direct the respondent No.1 to initiate legal action against the respondent No.2, 3,4 and 5, in the event of any offence committed by them against petitioner and her husband.

c.

To pass any other order or direction for safeguarding the life and liberty of the petitioner and her husband."

Mr. Anand V. Khatri, ASC (Criminal) for State, apprises the Court that subsequent to filing of the present petition, the Petitioner has been residing in Wazirabad. He submits that in terms of the prayers sought by the Petitioners, the necessary details of the police officer from the Wazirabad Police Station, which is the jurisdictional police station where the Petitioners are residing, shall be provided to them.

In light of the above, the SHO of the concerned Police Station is directed to provide adequate protection to the Petitioners. It is further directed that the beat constable of the concerned area shall be sensitized in this behalf. The telephone numbers of the concerned Police Station as well as of the beat constable shall also be provided to the Petitioners in order to enable them to contact the officers, in the event of any threat or apprehension.

With the above directions, the present writ petition is disposed of along with pending application.
