Petitioners seek recall of order dated 23.08.2016 by which the petition was dismissed as 'withdrawn'.

Petitioners' counsel urged that the petitioners do not intend to withdraw the present petition and get its disposal on merits. 3.

The petitioner has not given any cogent reasons as to why they opted to withdraw the petition on 23.08.2016. On merits also, the impugn order granting bail to the respondent No.2 suffers from no illegality. Order dated 08.12.2014 reveals that the respondent No.2 was in custody since 03.12.2014.

Primarily, it was a civil dispute between the parties. The accused failed to make certain payments in commercial transactions. It was noted that the parties were engaged in commercial transactions since 2012 and last transaction had taken place in August, 2013. During the said transactions, the accused had made certain payments to the complainant party. CRL.M.C. 775/2015

Considering the facts and circumstances of the case, no sufficient ground exists for cancellation of bail. The application and petition are dismissed.
