O R D E R

% 16.03.2018 Learned counsel for the petitioner submits that prosecutrix is aged about 40 years; whereas petitioner is aged about 24 years. Prosecutrix is petitioner's relatives. There is one month delay in lodging the FIR. It is contended that prosecutrix has alleged in the FIR that she had been raped by the petitioner on 13th and 17th January, 2017, however, she did not make any complaint to her husband.

Petitioner has been falsely implicated in the matter. Prosecutrix had been sending whatsapp messages to the petitioner, inasmuch as, had written a letter to him expressing her fondness for the petitioner.

Learned APP submits that investigations are complete and charge sheet has been filed.

Vide order dated 9th March, 2016 petitioner was granted interim

protection from arrest. This order is still continuing. Keeping in mind the totality of the facts and circumstances of this case, it is ordered that in case of arrest petitioner be released on bail, subject to his furnishing a personal bond in the sum of `10,000/- with one surety in the like amount to the satisfaction of the trial court.

Bail application is disposed of in the above terms. Dasti.
