Learned counsel for the petitioners submits that the present petition has been filed inadvertently assuming that the summons i.e., Annexure P-6 were issued on the complaint filed under Section 138 of the N.I. Act. However, later on during the inspection of the record it was revealed that the said summons were issued only on the point of limitation. 2.

In view of the above, learned counsel for the petitioners seeks leave to withdraw the petition.

Petition is dismissed as withdrawn. Miscellaneous application is disposed of as infructuous.
