Writ Petition under Article 226 of Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner for grant of Parole for a period of 03 months in FIR No. 0636/2016 under Sections 506 IPC, registered at P.S.: Govindpuri, Delhi. 2.
It is submitted that on 31.10.2022, the Petitioner was sentenced to undergo RI for 10 years for offence under Section 506 IPC and Section 6 POCSO Act. His Appeal was dismissed by this Court in the year 2023 and his brother Raju Das has expired on 05.03.2017. There is none in the family to do necessary repairs of his house. Hence, prayer is made for grant of Parole. 3.

Reply dated 08.10.2025 was received from Police officials of PS: Govindpuri, Delhi stating that they have done verification of the residential address of the Petitioner and have recorded the Statements of his wife, sister-in-law and neighbours, from which it has emerged that Petitioner and The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
his family have been residing there for the last 15 years and the house was co-owned by his brother Raju Das, who was capable of doing renovation works, but has died on 05.03.2017.

Learned APP for the State submits that factum of demise of Petitioner's brother Raju Das has been verified.

Record shows that unexpired portion of the sentence is only six month sentence out of 10 years. Also, factum of death of Petitioner's brother Raju Das has been verified. There is none in the Petitioner's family to carry out the requisite renovation of his house, as his family comprises of his wife and two daughters.

Considering the submissions made and the fact that after the demise of Petitioner's brother, he is granted parole for a period of four weeks in FIR No. 0636/2016 under Sections 506 IPC read with Section 6 POCSO, registered at P.S.: Govindpuri, Delhi, upon his furnishing a personal bond in the sum of Rs.10,000/- and one surety of the like amount to the satisfaction of the Jail Superintendent and subject to the following conditions:- a) Petitioner shall appear before the Court as and when the matter is taken up for hearing;
b) Petitioner shall provide his mobile number to IO/SHO concerned, which shall be kept in working condition at all times; c) Petitioner shall inform the IO/SHO and the Jail Superintendent, about the address where he shall be available in Delhi; d) Petitioner shall ordinarily reside at the address mentioned in the Petition;
