The present petition has been filed seeking grant of parole for a period of four weeks to the petitioner, who is convicted under Sections 302/34 of the Indian Penal Code, 1860 in connection with FIR No. 484/2003, PS Adarsh Nagar, and is presently undergoing sentence of rigorous imprisonment for life, to enable him to perform rituals on the death anniversary of his mother, late Smt. Lilawati, and to maintain social ties. 2.

As per the verification/status report filed by the respondent, the rituals for the death anniversary of the petitioner's mother are scheduled to be conducted from 13.11.2025 to 15.11.2025 at A-364, Durga Mandir, Shastri Nagar, Delhi. An enquiry was conducted from the neighbours, namely Manju and Santosh (mother of Pairokar Tisha), and their statements were recorded. As per the said enquiry and statements, it has been confirmed that the petitioner's mother expired on 13.11.2021 and that her yearly shraadh/death anniversary ceremony is scheduled to be held from 13.11.2025 to 15.11.2025 at A-364, Durga Mandir, Shastri Nagar, Delhi. 4.

This Court has perused the verification/status report, the statements appended thereto, as well as the invitation card relating to the death anniversary of the petitioner's mother. On the basis of these documents, it stands verified that the death anniversary function is scheduled to take place between 13.11.2025 and 15.11.2025.

In view of the above and considering that the purpose of parole includes enabling a convict to maintain family and social ties and to perform important familial rituals, this Court is of the opinion that the grounds urged by the petitioner are genuine. However, the Court is of the view that the petitioner can be granted parole for a shorter duration than what has been prayed for.

Accordingly, the present petition is allowed. The petitioner is granted parole for a period of two weeks from the date of release, upon furnishing a personal bond of ₹15,000/-, with the cash surety to be deposited with the concerned Jail Superintendent, to the satisfaction of the concerned Jail Superintendent, on the following conditions:

inducement, threat or promise to any person acquainted with the facts of the case;

iii.

The petitioner shall provide his mobile number(s) to the Jail Superintendent and keep it operational at all times; iv.

The petitioner shall commit no offence whatsoever during the period he is on parole;

v.

The petitioner shall intimate the concerned Court/Jail Superintendent in case of change of residential address and/or mobile number;

vi.

The petitioner shall report to the jurisdictional Police Station on every Wednesday of the week; and vii.

The concerned Jail Superintendent shall hand over a chit to the petitioner indicating his date of surrender.

With the aforesaid directions, the petition stands disposed of along with the pending application(s), if any.

Copy of this order be sent to concerned Jail Superintendent for compliance.
