This is a writ petition under Article 226 of the Constitution of India read with Section 528 of BNSS, 2023 for quashing of FIR No. 758/2025, under Sections 115(3)/126(2)/351/3(5) BNS, 2023, registered at Police Station Burari.

Learned Standing Counsel appearing on behalf of State submits that FIR has been recently registered on 19.08.2025 and the allegations are still being investigated. and enquiry has been made from him. He further states that petition is premature as investigation is still at an initial stage. 3.

In view of the aforesaid submissions of learned Standing Counsel, Mr. Ashok Kumar, learned counsel appearing for the petitioner, seeks permission to withdraw the present petition.
