The present petition has been filed on behalf of the petitioner under Section 483 of BNSS, 2023 seeking regular bail in connection with FIR No. 218/2025, under Sections 115(2)/118/109(2)/3(5) BNS Act & 27 of Arms Act registered at PS-Mansarovar Park.

The case of the prosecution is that on 03.05.2025 at about 11.00 AM, the complainant/Rohit Goswami made a complaint that an unknown person had come into his office and started inquiring about the staff members. When the complainant asked about it, the unknown person started abusing and fighting with him and ran away leaving his motorcycle at the spot. 3.

persons who were residing behind his office and fight had taken place between complainant and the said persons in which complainant is stated to have suffered injuries.

Mr. M.L Yadav, learned counsel appearing on behalf of the petitioner submits that injuries received by the complainant are simple and no recovery of weapon has been made from the petitioner.

He further contends that there is no specific role attributed to the present petitioner and he does not have any previous involvements. 6.
Per contra, Mr. Ajay Vikram Singh, learned APP appearing on behalf of State argued on the lines of the status report. 7.
Having heard learned counsel for the applicant/petitioner as well as learned APP for State, this Court had put a specific query to the learned APP as to the nature of injuries suffered. On instructions from the IO, who is present in Court, he submits that the injuries suffered by the complainant are simple in nature. He has further apprised the Court that no weapon was recovered in this case 8.
A perusal of status report shows that there is a CCTV footage available. However, as per the status report, only the sound of firing of a gun is audible in the CCTV footage.

It is also not in dispute that petitioner has clean antecedents. It is not the case of the petitioner that he is a flight risk. 10.
The petitioner is in custody since 03.05.2025 and in the circumstances of the present case no purpose will be served to keep the petitioner in custody to await the outcome of trial, which will take some time. 11.

surety of the like amount to the satisfaction of the learned Trial Court/JMFC/Duty JM, further subject to the following conditions: a. Petitioner shall appear before the Court as and when the matter is taken up for hearing.
b. Petitioner shall provide mobile number to the IO concerned which shall be kept in working condition at all times and he shall not change the mobile number without prior intimation to the Investigating Officer concerned.
c. Petitioner shall not come in contact with the complainant or any or other witnesses.

It is clarified that the observations made herein above are only for the limited purpose of deciding the present bail application and the same shall not be construed as an expression of opinion on merits of the case. 13.
The application is disposed of.

Copy of the order be forwarded to the concerned Jail Superintendent for necessary compliance.
