This is an application under Section 151 of the CPC, 1908 seeking condonation of 45 days delay in filing the petition. 2.

In the present case, the petition under Section 34 of the Arbitration and Conciliation Act, 1996 has been filed seeking to challenge the Arbitral Award dated 07.04.2025.

Mr. Gupta, learned counsel for the petitioner, states that the Award was received by the petitioner on 09.04.2025 4.

Admittedly, the present petition has been filed for the first time on 20.08.2025.

which expired on 09.07.2025 and adding another period of 30 days takes the maximum period of limitation for the petitioner to 09.08.2025. 6.

The filing of the petition on 20.08.2025 is beyond 120 days and in view of the law laid down in Union of India v. Popular Construction Co., (2001) 8 SCC 470 this Court does not have power to condone the delay beyond 120 days.

Hence, the application is dismissed since the petition is beyond the statutory period of limitation and the same cannot be entertained. O.M.P. (COMM) 444/2025 8.

This is a petition filed under Section 34 of the Arbitration and Conciliation Act, 1996 seeking to challenge the Arbitral Award dated 07.04.2025.
