Heard learned counsel for the appellant-Association and Mr.Manu Chaturvedi, learned counsel for respondent-MCD. 2.

Learned counsel for the appellant-Association states that in case, the respondent-MCD provides a facility of making the deposit of the entire amount in terms of the impugned judgment passed by the learned Single Judge in three equal instalments in a span of three months, the appellantAssociation will withdraw the instant appeal. 3.

Mr. Manu Chaturvedi, learned Standing Counsel for respondent-MCD has, however, stated that the demand by the respondent-MCD has been raised to only 16 members of the appellant-Association, for the reason that certain documents were required to be furnished from the individual members to the respondent-MCD, but only 16 out of the total members had furnished their documents.

In the aforesaid view of the matter, the instant appeal along with pending application stands disposed of in the following terms: (i) The remaining members of the appellant-Association, who are yet to furnish the documents demanded by the MCD, shall furnish the same to the MCD, within a period of 10 days from today, except those who have already submitted.

(ii) On receipt of the said details, the respondent-MCD shall raise the demand to such remaining members in terms of the impugned judgment passed by the learned Single Judge whereupon, the members of the appellant-Association shall make deposit of the said demanded amount in three equal instalments spanning over a period of three months. (iii) The period of three months shall start from the date the demand notices are served to such remaining individual members of the appellantAssociation. (iv) So far as the members included in the list submitted by the learned counsel for the appellant-Association today before the Court are concerned, the period of three months for making the deposit of the demanded amount The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

(v) In case, any individual member/members do not comply with the terms of this order, it will be open to the respondent-MCD to take all legally permissible steps, including coercive measures, for realisation of the amount in terms of the impugned judgment passed by the learned Single Judge.
