IN THE HIGH COURT OF DELHI AT NEW DELHI

+ W.P.(C) 3609/2013 RAJ KUMAR & ORS.

..... Petitioners Through None versus MUNICIPAL CORPORATION OF DELHI & ANR...... Respondents Through Mr. G.D. Mishra, Standing Counsel for respondent No. 1/SDMC.

CORAM:

HON'BLE MR. JUSTICE SIDDHARTH MRIDUL

O R D E R

% 09.07.2018 CM No. 26558/2018 (filed by the petitioner for direction) None appears on behalf of the applicants/petitioners. A perusal of the application reflects that the applicants/petitioners seek revival of the writ petition, which came to be disposed of by this Court vide order dated 17th April, 2015. The prayer for revival is predicated on the assertion that the private respondents have begun to raise illegal and unauthorized construction afresh.

A perusal of the photographs annexed to the present petition as Annexure 3 on internal page 21, clearly demonstrates that the action taken on behalf of the Municipal Corporation of Delhi, against the unauthorised construction is axiomatic and no fresh unauthorised construction is evident. Be that as it may, since none appears on behalf of the applicants/petitioners, the application is dismissed in default and for nonprosecution. SIDDHARTH MRIDUL, J JULY 09, 2018/RS
