The case diary has been perused.

The Investigating Agency is correct in submitting that in the FIR, there was no allegation of any firing, such allegations having been levelled later, that too after supplementary statement had been recorded, 21 days having elapsed after the registration of the FIR. Be that as it may, the SHO clarifies that in the CCTV footage, copy whereof was presented by the petitioner, there are fleeting images of two persons moving on the public space, even their identity or complicity in the CRL.M.C. 1401/2018

crime having not been established or indicated by the petitioner, not even remotely. The SHO, nonetheless, assures that hereafter he would effectively monitor the investigation so as to take it to its logical end at the earliest. The petitioner, in fact, should have approached the Metropolitan Magistrate, if he had any grievance vis-a-vis the investigating process, in terms of the ruling of the Supreme Court in Sakiri Vasu v. Staste of UP AIR 2008 SC 907. No further directions at this stage are called for. The petition stands disposed of.
