After arguments, this appeal is disposed of as not pressed with the consent order by setting aside the impugned judgment dated 6.1.2018, however, that will be no reflection on merits of the case of either of the parties and all aspects of facts and law, which will arise in the suit, will be decided by the trial court at the stage of final arguments after parties have led evidence.

It is once again clarified that all issues of facts and law including the aspects which are dealt with in the impugned judgment are left open for being decided by the trial court at the stage of final arguments. 2.

Parties to appear before the District and Sessions Judge, North West,
