% 16.05.2018 Notice could not be issued to respondent no.2 as steps were not taken, however, respondent no.2 along with her counsel is present in court and has been identified by SI Rajiv of Police Station Rajouri Garden. She accepts notice and submits that she has settled the matter with petitioner no.1 of her free will and without any undue force or pressure. He further submits that her marriage with petitioner no.1 has already been dissolved by decree of divorce by mutual consent dated 08th November, 2017 passed by Family Court, Dwarka Courts, Delhi for full and final settlement amount of `6,50,000/-;
She has received entire settled amount and has no objection in case FIR No. 675/2016 under Sections 498A/406/34 IPC registered at police station Rajouri Garden and the consequent proceedings emanating therefrom are quashed against the petitioners.
Keeping in mind, the settlement arrived at between the petitioner no.1 and respondent no. 2 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms.
