% 07.03.2017 Issue notice. Notice is accepted on behalf of the State. Respondent nos.2 and 3 are present in court and accepts notice. They are identified by the I.O. who is present in court.

The petitioner has preferred the present writ petition to seek the quashing of FIR 180/2015 registered under Section 363 IPC at PS Paschim Vihar. Respondent no.2 is the complainant and the victim/ respondent no.3 is the sister of respondent No.2.

Ms. Vohra has read out the statement made by respondent No.3 under Section 164 Cr PC. She submits that the respondent No.3 was below 18 years of age at the time when the petitioner allegedly forcibly took away her with him to his sister's place. The offence is thus serious.

However, to atone for the said conduct, the petitioner expresses regret and also leaves it to this court to subject to him to such costs as this court may consider appropriate. Respondent nos.2 and 3 states that they have arrived at the settlement voluntarily without any coercion and therefore do not wish to pursue the complaint any further. Since the petitioner is ready and willing to atone for his conduct and respondent nos.2 and 3 do not wish to pursue their complaint, the FIR and the proceedings arising therefrom are quashed subject to payment of costs of Rs.20,000/- by the petitioner with the Prime Minister's National Relief Fund. Costs be deposited within two weeks and the receipt thereof be produced to the I.O., and whereafter the case shall be closed. VIPIN SANGHI, J MARCH 07, 2017 sr
