Issue notice. Ms.Anita Sahani, learned counsel for the respondent, who appears on advance notice submits that the petitioner has been suspended from the hostel only in view of the various allegations levelled by a number of students regarding, his invplvement in a ruckus created by some students in the hostel in night preceding 'Holi'. She further submits that in order to have a fair enquiry the respondent have decided not to permit the petitioner to continue to stay in the hostel as his presence in the hostel is likely to affect fair investigation. Certify that the digital and physical file have been compared and the digital data is as per the physical file and no page is missing.
0^ Learned counsel for the respondent, on instructions, submits that the enquiry into the incident will be positively completed within 10 days, after following due process as per rules.
Keeping in view the categoric, statement made on behalf of. the respondents that the enquiry would be completed within ten days, this Court is not inclined to interfere with the impugned order. However, the I petitioner is granted time till 6 p.m on 15.03.2018 to vacate the hostel. It is however made clear that in case the respondent does not pass any order based on the enquiry within 10 days, the petitioner will be entitled to rejoin the hostel on 25.03.2018.
The petition is accordingly disposed of alongwith all the applications in the above terms.
