The present petition has been filed seeking interim bail in connection with FIR No. 189/2023 under Sections 302/34 IPC registered at Police Station Punjabi Bagh.

Mr. Vineet Jain, learned counsel for the petitioner submits that the present petition has been filed seeking interim bail on the ground of marriage of the petitioner's real sister's which is scheduled on 02.11.2025. 5.
Mr. Jain invites attention of the Court to the order dated 25.10.2025 of learned ASJ-02, (West), Tis Hazari Courts, Delhi to contend that the factum of the marriage has already been verified by the I.O and the same has been recorded in the said order.

has been premised on the ground that the testimony of the two material witnesses i.e. PW-4/Ranbir Singh and PW-6/Rambir Singh is yet to be recorded.

Mr. Jain submits that PW-4/Ranbir Singh has been examined, crossexamined and discharged. 8.
In view of the above, issue notice. Ms. Richa Dhawan, learned APP for the State accepts notice.

On instructions from the I.O/ Insp. Dinesh Kumar, she submits that the material witness namely Khushal Singh has not been examined, however, this position is controverted by Mr. Jain. He contends that Khushal Singh has also been examined as PW-2 and discharged. He has also shown copy of testimony of PW-2 to the IO in Court during the course of hearing.

Having regard to the fact that the factum of marriage stands verified and the same is scheduled on 02.11.2025 i.e. day after tomorrow (Sunday), therefore, the present application is allowed and the petitioner is granted interim bail for a period of 10 days subject to the petitioner furnishing a Personal Bond in the sum of Rs. 20,000/- and one Surety Bond of the like amount to the satisfaction of the Trial Court/CJM/Duty Magistrate, further subject to the following conditions:- a) Petitioner shall provide mobile number to the IO concerned which shall be kept in working condition at all times and he shall not change the mobile number without prior intimation to the Investigating Officer concerned.
n) Petitioner shall not indulge in any criminal activity and shall not communicate with or come in contact with the witnesses. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Upon expiry of the period of 10 days as stated above, the petitioner shall surrender before the Jail Superintendent. 12.
The petition stands disposed of.

Copy of the order be forwarded to the concerned Jail Superintendent for necessary compliance and information.
