Learned counsel for the petitioner submits on instructions from Mr. Dhan Prakash, authorised representative of the petitioner present in Court that the petitioner has re-instated respondent No.2 and has also paid the back wages till February, 2017 and, therefore, the petitioner may be permitted to withdraw this writ petition. The copy of the authority letter of the authorised representative is handed over and taken on record. 2.
Respondent No.2 submits that Rs.75,904/- is still outstanding and payable by the petitioner.

The petitioner is directed to examine the respondent No.2 and make the payment of outstanding amount to him within a period of four weeks from today.

Learned counsel for the petitioner seeks refund of the amount deposited in terms of the order dated 31st May, 2011. 5.
The writ petition is dismissed as withdrawn. The registry shall refund the amount deposited by the petitioner after the clearance of the outstanding dues of respondent No.2 by the petitioner. The petitioner shall file an
affidavit along with the receipt of the clearance of the dues as well as no objection of respondent No.2 whereupon the registry shall refund the deposited amount to the petitioner.

The Lower Court record be returned forthwith. 7.
Copy of this order be given dasti to counsels for the parties under signature of Court Master.
