W.P.(CRL) 794/2018 Petitioners are seeking quashing of the present FIR i.e. the FIR No.0314/2016 registered under Sections 498A/406/506/34 of the IPC at police station C.R.Park on the complaint of respondent no.2. Respondent no.2 is present. Her presence has been identified by the Investigating Officer as also by her counsel. Parties have now been divorced by a decree of mutual consent dated 19.02.2018. No child was born out of their wedlock. It is agreed that a sum of Rs.1 crore will be paid by petitioner no.1 to respondent no.2 of which Rs.50

lakhs already stand paid to respondent no.2. It is stated that an FDR in the sum of Rs.50 lakhs is lying deposited in the name of the Family Court Judge Madhu Jain, Saket Courts. It has been agreed that this sum of Rs.50 lakhs along with the accrued interest shall be paid over to respondent no.2 and that will culminate in the full and final satisfaction of the terms of the settlement arrived inter the parties. The terms of the settlement are endorsed in terms of the settlement deed dated 26.12.2017 which is a part of the record. In view of the aforenoted settlement arrived at between the parties, this is a fit case where the prayer made in the petition be granted. Accordingly to secure ends of justice, FIR No.0314/2016 registered under Sections 498A/406/506/34 of the IPC at police station C.R.Park and all the proceedings emanating therefrom stand quashed.

Petition disposed of.
