The petitioner has filed this petition under Section 14 read with Section 15 of the Arbitration & Conciliation Act, 1996 seeking termination of the mandate of Sh. D.V. Raghav, Superintendent Engineer, who was appointed as the Arbitral Tribunal.

It is contended in the petition that Mr. D.V. Raghav was the Superintendent Engineer and was connected with the work, which is the subject matter of the arbitration proceedings and, accordingly, he could not have been appointed as the Arbitral Tribunal. 3.
Learned counsel for the petitioner submits that pending this petition, Mr. D.V. Raghav, Superintendent Engineer (Arbitral Tribunal) has resigned and, accordingly, the present petition has become infructuous. 4.
In view of the fact that Mr. D.V. Raghav, Superintendent Engineer (Arbitral Tribunal) has resigned, the petition has become infructuous. 5.
