% 03.07.2018 After some hearing the counsel for the petitioner submitted that he may be allowed to withdraw the present bail petition and the application filed therewith, though his request being that the prosecution be directed to ensure that the evidence of the prosecutrix is recorded without further delay. The counsel present for the prosecutrix assures that she would appear for her testimony through video conferencing for 10th July, 2018 as is already fixed and all arrangements are in the process of being put in position.
In the given facts and circumstances, it is hoped and expected that the State will take all measures to ensure that the statement of the prosecutrix, a US national, is recorded expeditiously at an early date. Needless to add, the petitioner will be entitled to move fresh application before the court of Sessions after the deposition of the prosectrix has been recorded. The present bail petition and the application filed therewith are dismissed as withdrawn.
