The present appeal under Section 19 of the Family Courts Act, 1984 seeks to assail the order dated 31.08.2024 passed by the learned Family Court, Shahdara District, Karkardooma Courts, Delhi in HMA No. 855/2021. Vide the impugned order, the right of the appellant to crossexamine the respondent/husband has been closed by the learned Family Court.

After some arguments, learned counsel for the appellant submits that since the impugned order is a procedural order, the appellant may be granted leave to withdraw the present appeal with liberty to file an appropriate petition under Article 227 of the Constitution of India to assail the said order.

As prayed for, the appeal is alongwith the accompanying applications, disposed of as not pressed with liberty as prayed for. We, however, make it clear that since we have not expressed any opinion on the merits of the grounds raised in the present appeal, it will be open for the appellant to raise all permissible grounds including grounds raised in the present appeal in the petition under Article 227 of the Constitution of India, which she may choose to file.
