% 13.10.2017 Review Petition 440/2017 (on behalf of the plaintiff) 1.

It is not in dispute that the matter was referred to Delhi High Court Mediation & Conciliation Centre for settlement. The matter was settled there vide settlement agreement dated 24.05.2017. The applicable section is 16 of the Court Fee Act and the plaintiff is entitled to a certificate from the Court authorising him to receive back from the collector the full amount of the fee paid in respect of plaint. 2.

Accordingly, order dated 28.08.2017 is reviewed and the plaintiff shall be entitled for refund of full Court fee under Section 16 of the Court Fee Act. Necessary certificate be issued to the plaintiff. 3.

The application stands disposed of.
