It has come to the notice of the Court that the petitioner had earlier filed a petition being W.P.(C) 6254/2013 wherein vide order dated 30.09.2023 Court had granted interim stay against the operation of the Award. The said writ petition was dismissed for non-prosecution vide order dated 01.09.2023. Thereafter, petitioner had filed an application for restoration of the petition on which a notice has already been issued, and the said writ petition is still pending.

Despite the fact that the writ petition challenging the Award is still pending, the present petition has been filed for stay of the execution proceedings.
