The petitioner has sought directions to the labour authorities to execute order dated 21.09.2021 whereby an ex-parte award of compensation was passed in favour of the petitioner workman for the injuries suffered in the year 2009 and admittedly there is no medical evidence connecting the injury with the occupation. In any case, since the respondent is already conducting the recovery proceedings in accordance with law, learned counsel for petitioner seeks permission to withdraw this petition with liberty to move appropriate application before the respondent and depending upon outcome of the same, approach this court again.
