% 24.07.2017 Crl. M. A. No. 11599/2017 (Impleading LRs of the deceased) and Crl. M. A. No. 11598/2017 (Grant of compassionate appointment to LRs of the deceased) By the present applications, the petitioner seeks impleadment of legal heirs of the deceased/petitioner as a necessary party in the present case and also direction to the respondent to grant the benefits of the deceased appellant to the legal heirs of the appellant including grant of compassionate appointment to one legal heirs.

Learned counsel for the applicants submits that the appellant expired on 05.04.2016 during the pendency of the appeal, leaving behind her wife, one daughter and two son and prays that legal heirs of the appellant be impleaded as a party in the present case. True copy of the death certificate is annexed with the application.

The appellant was convicted vide order dated 26.03.2010. The appellant was reinstated vide order dated 28.02.2014 but expired on

05.04.2016. The legal heirs of the appellant approached the employer of the appellant for release of service, monitory benefits to them. It is now prayed that direction be issued to the respondent to grant benefits to the applicants including grant of compassionate appointment to one legal heir. The present applications are misconceived and there being no merit, the same are dismissed.

Crl. A. 670/2010 In view of the submission made by the learned counsel for the appellant that the appellant expired on 05.04.2016, the proceedings against the appellant stand abated.
