This is a writ petition seeking parole to the petitioner for a period of 6 weeks in FIR No. 279/1992 registered at PS Sadar Bazar under Sections 302/307/34 of IPC, Sections 25/27/54/59 of Arms Act and Section 5 of TADA (P) ACT, 1987 on the ground that the wife of the petitioner has to undergo a surgery for uterus removal. 2.

As per the Nominal Roll of 04.12.2024, the petitioner has been sentenced under Sections 302/307/34 of IPC and Section 5 of TADA (P) ACT 1987 for rigorous imprisonment for life. The petitioner has undergone a period of 28 years 7 months 11 days and earned remission of 5 years 5 months 3 days, totalling to about 34 years. 3.

The factum of the surgery has been verified.

Mr. Khatri, learned ASC has handed over a status report, wherein the medical documents of the wife of the petitioner have been verified. 5.

For the said reasons, the petition is allowed and the petitioner is granted parole for a period of 4 weeks from the date of his release for the purpose of surgery of the wife of the petitioner. granted parole on the following terms and conditions:- (a) The petitioner shall furnish a personal bond and a surety bond in the sum of Rs. 10,000/- (Rupees Ten Thousand Only) to the satisfaction of the Jail Superintendent;

(b) The petitioner shall furnish his cellphone number to the concerned Investigating Officer ('IO') on which the petitioner may be contacted at any time and shall ensure that the number is kept active and switched-on at all times;

(c) The petitioner will furnish his permanent address to the IO and in case he changes his address, he will inform the IO concerned; (d) The petitioner shall not indulge in any act or omission that is unlawful or that would prejudice the proceedings in pending cases, if any.

(e) Upon expiry of the period of parole, the petitioner shall surrender before the Jail Superintendent.

The petition is allowed and disposed of.
