Petitioners seek initiation of contempt proceedings with respect to the directions contained in order dated 28.08.2024 passed by the learned Coordinate Bench of this Court in W.P.(C) 11809/2024. 2.
The grievance of the petitioners was with respect to the unauthorized construction being raised in flat Nos.14, 48, 61, 62, 75, 162 and 165 of Evergreen CGHS Ltd., Sector 7, Dwarka. 3.
The above said writ petition was disposed of with the direction to DDA to take appropriate action in accordance with law within a period of six weeks after hearing the parties.

Learned counsel for DDA, who appears on advance notice, submits that DDA has already taken requisite action by passing order dated 07.10.2024. A copy thereof has been shown during course of the hearing and it is undertaken that such copy shall be supplied to learned counsel for the petitioner during course of the day. 5.
It is informed that with respect to all the above seven flats, a show-cause notice has been issued and, thereafter, there is an order of sealing as well as of demolition.

It is, however, submitted that DDA is in the process of formulating a Standard Operating Procedure (SOP) to carry out the procedure with respect to the demolition in such type of matters and once such SOP is finalized, appropriate demolition action shall be taken. The aforesaid exercise of formulating SOP is being carried out in terms of the directions given by the Hon'ble Supreme Court on 17.09.2024 in W.P.(C) 295/2022.

In view of above, learned counsel for the petitioners, on instructions, submits that, at the moment, the petitioners do not press their present contempt petition. He, however, states that if no further demolition action is undertaken with respect to the flats in questions in near future, he may be permitted to revive the present contempt petition.

The petition is, accordingly, disposed of as not pressed. Liberty, as prayed, is granted.
