By way of the present petition, the petitioner is seeking quashing of the FIR bearing no. 47/2019, registered at Police Station Burari, New Delhi, for the commission of offences punishable under Sections 363/376 of the Indian Penal Code, 1860 (hereafter 'IPC').

The petitioner and respondent no. 2 are present before this Court and have been identified by their counsel and Investigating Officer (IO) concerned from Police Station Burari, New Delhi. 6.

Brief facts of the case are that the petitioner and respondent no. 3 acquainted through Facebook and gradually developed a friendly relationship, which after a few months, they culminate into a relationship. On 11.02.2019, the respondent no. 3 had told the petitioner that she had a quarrel at her house and does not want to stay there and asked the petitioner to take her away with him. On 11.02.2019 at 02:30 PM, the respondent no. 3 had left her home on pretext of attending tuition and subsequently met the petitioner in Delhi and thereafter, both had gone to Panipat with their free will and consent. Upon the complaint by respondent no. 2 i.e. the mother of the respondent no. 3, the present FIR had been registered against the petitioner under the relevant sections. It is further stated that on 13.02.2021, the petitioner and respondent no. 3 got married and the marriage was registered on 17.12.2025 and living together since 13.02.2021 with each other.

On a query made by this Court, respondent no. 2 and respondent no.3 who have been identified by the IO, have categorically stated that they have no objection if the present FIR is quashed.

In view of the above, that the parties have amicably resolved their differences of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 9.

Accordingly, FIR bearing no. 47/2019, registered at Police Station Burari, New Delhi, for the commission of offences punishable under Sections 363/376 of IPC and all consequential proceedings emanating therefrom are quashed.
