The present petition seeks quashing of Criminal Complaint No. 1776/2003, filed by Respondent No. 2 against the Petitioner before the Judicial magistrate, First Class, Saket Courts, New Delhi. 2.

The Petitioner has raised several objections regarding the maintainability of the impugned criminal compliant and the issuance of summons, contending inter alia that there is no legally enforceable debt or liability and that the cheque in question was issued only as a security cheque.

However, after making some submissions, counsel for the Petitioner states that he would like to withdraw the present petition with liberty to urge all such grounds before the Trial Court, at the appropriate stage. 4.

Leave and liberty as prayed for are granted.
