Writ Petition under Article 226/227 of Constitution of India read with Section 528 of Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner-Ravinder Rana seeking Parole for a period of 02 months and for exemption from surrendering on expiry of his furlough period. 2.

It is submitted that the Petitioner was arrested and tried in case FIR No. RC-1(S)/2005/SCU-1 under Sections 302/307 IPC and Section 27 of Arms Act.

On 31.01.2013, the Petitioner was sentenced for life and has undergone 21 years in judicial custody with a good track record and conduct. On 21.01.2023, his father underwent Prostrate surgery as he is a Prostrate cancer survivor.

On 10.05.2025, he suffered severe pain for about one month and was admitted for evaluation on the advice of his Oncology Doctor. Since 15.05.2025, his father has been going for regular follow up with concerned doctors.

His Application for Parole was rejected by the Jail Authorities on 15.07.2025 stating that if the Petitioner is eligible for Furlough, he may be so released. Since 17.10.2025, Petitioner is out on Furlough for 14 days and has to surrender on 01.11.2025. Hence, the Petition has been filed seeking Parole for 60 days on the medical condition of his father as well as the ailing condition of his mother.

Learned ASC for State submits that he is at liberty to file a Parole Application, which will be considered by the Jail Authorities in accordance with Jail Manual Rules.

From the submissions made and the Petition itself, it is evident that since May, 2025, the father is having complication on account of cancer, which seems to be continuing.

No Parole Application has been filed, not the same can be filed till one month from the date of surrender. Therefore, his prayer for grant of Parole for 02 months, cannot be considered. However, considering the medical condition of the father, Furlough is extended till 06.11.2025, on which date, he shall surrender before the Jail Authorities. 9.

The Petition alongwith pending Application, is accordingly disposed of with liberty to the Petitioner to move the Application for Parole before the Jail Authority, who shall consider it on the compassionate ground pleaded by the Petitioner.
