The present petition has been filed under Article 226 of Constitution of India read with Section 528 BNSS, 2023 seeking quashing of FIR No. 0293/2022 under Sections 498-A/406/34 IPC registered at Police Station Mayur Vihar, Phase-I, Delhi and all consequential proceedings emanating therefrom on the ground that the parties have arrived at a settlement. 4.

matrimonial dispute and parties have arrived at a settlement, the State has no objection in case the FIR in question is quashed. 6.

The petitioner no.1 (husband), petitioner nos. 2 to 4, who are close relatives of petitioner no. 1, as well as, respondent no. 2 (wife) are present in the Court and they have been identified by their respective counsels, as well as, by the Investigating Officer i.e. SI Ajay Sharma, P.S. Mayur Vihar, Delhi.

The brief facts of the case are that the marriage between the petitioner no.1 and respondent no. 2 was solemnized on 11.11.2017 according to Hindu Rites and Customs.

On account of certain misunderstandings between the parties, the respondent no. 2 lodged the aforesaid FIR.

During the pendency of the proceedings, the parties were referred to Counselling Cell of Family Court, Dwarka where they arrived at a settlement, terms whereof were reduced in writing in the form of Settlement dated 19.12.2022 which is annexed as Annexure B to the present petition. 10.

Subsequently, another Compromise/Settlement Deed dated 29.10.2025 has been executed between the parties which is annexed as Annexure-C to the present petition.

In terms of the said settlements, the parties amicably resolved all their disputes and started living together peacefully. 12.

It has been agreed between the parties that they shall cooperate with each other in all possible manner, and shall fulfil all their duties and responsibilities towards each other and their family members. It is also a term of the settlement that parties shall cooperate with each other in quashing of the aforesaid FIR.

The respondent no.2, on a query posed by the Court, affirms the fact that the parties are living together for three years as husband and wife and also states that she has no objection if the FIR in question is quashed. 14.

In view of the fact that the parties have arrived at a settlement, no useful purpose will be served in continuing the proceedings, rather the same would create further acrimony between them.

It is, thus, in the interest of justice that the present FIR and all the other proceedings emanating therefrom be quashed. 16.

Consequently, the petition is allowed and the FIR No. 0293/2022 under Sections 498-A/406/34 IPC registered at Police Station Mayur Vihar, Phase-I, Delhi and all consequential proceedings emanating therefrom, is quashed.

The petition stands disposed of in the above terms. 18.
