% 03.12.2018 At the outset, the learned Standing Counsel for the respondent submits, upon instructions, that the writ petition is not maintainable because the petitioner has preferred an equally efficacious alternate remedy as provided under the relevant statute.
The petitioner by the order dated 10.05.2018 was released a car bearing No. DL 10 CG 6624 on superdari basis. Subsequently, the attachment has been confirmed by the Adjudicating Authority and the petitioner has filed a statutory appeal against the said order, which is pending before the Appellate Tribunal.
In the circumstance, till the appeal or application for interim directions/relief apropos the car is decided, the interim order shall remain operational.
No further orders are required at this stage.
