O R D E R
% 16.03.2017 Further status report has been filed. I have heard counsel for the petitioner, the learned APP as well as counsel for the complainant. To show his bonafides, the petitioner has submitted that he shall pay to the complainant an amount of Rs.5 lakhs within 7 days. The said amount shall be transmitted through RTGS in the bank account of the complainant. Further amounts of Rs.2.50 lakhs each shall be paid in two instalments, which shall be paid by 30.04.2017 and 31.05.2017 respectively through RTGS to the complainant.
The said payment shall be made without prejudice to the rights and contentions and defences available to the petitioner as well as the complainant. The same shall be in addition to the return of the articles as per the list tendered by Mr. Mittal in court today under his initials, which is
taken on record. A copy of the said list has been provided to the learned APP. The same may be collected by the complainant as well. The articles shall be returned to the complainant within one week in the presence of the I.O. and a record of the same shall be maintained by the I.O. The Dezire Car shall, however, be retained by the petitioner. Mr. Mittal, on instructions, also states that for the medical treatment of the minor child of the parties, the petitioner shall bear the expenses on actual basis. The complainant may provide the bills for the professional fee, hospitalization and medication in this regard through the I.O. to the petitioner. The said amount shall be paid by the petitioner preferably within one week.
Subject to compliance of the aforesaid conditions, it is directed that in case of his arrest, the petitioner shall be released on bail upon his furnishing a personal bond with one surety in the sum of Rs.10,000/- to the satisfaction of Arresting Officer/ IO. He shall provide his mobile phone number to the IO, which shall be kept in working condition at all times. The same shall not be changed without prior intimation to the I.O. He shall join the investigation as and when called for. He shall not tamper with the evidence or influence any of the prosecution witness.
