O R D E R

% 09.08.2016 CA Nos.948, 956 & 973 of 2016 These three applications have been moved by the appellants seeking condonation of delay, which is stated to be of 231 days each in filing the

appeals noted above. For the reasons stated and looking to the overall circumstances of the matter, the delay is condoned subject to payment of costs of Rs.1,100/- in each case, which shall be deposited with the Official Liquidator within ten days from today and the same shall be credited to the account of the company in liquidation. The aforesaid appeals are taken on record.

These applications are disposed off.

CO.A(SB) Nos. 8-10/2016 All these three appeals were principally concerned with the nonconsideration of the appellants' claims, which were based on Fixed Deposit Receipts ('FDRs') in each of the matter, on the ground of non-availability of the original FDRs. Counsel for the Official Liquidator states that during the pendency of these appeals; the appellants have now furnished the original FDRs to the Official Liquidator.

Looking to the circumstances and as agreed between the parties, and to my mind also, these appeals can be disposed off by the direction to the Official Liquidator to now consider the claims filed by these appellants in the light of the original FDRs having become available and to dispose off the same on merits within four weeks from today with due intimation to the claimants in that behalf. It is ordered accordingly. All the appeals are disposed off.

A copy of this order be given dasti to counsel for the parties. SUDERSHAN KUMAR MISRA, J.
