Noting that the settlement does not embrace the petitioners No.1 and 2 in the instant petition, the counsel for the petitioners seeks leave to withdraw the petition stating that the petitioner intends to enter into a settlement with respondent No.2 : the complainant, and then seek quashing of the FIR and the proceedings emanating therefrom.

Needless to state if the petitioner enters into a settlement with the complainant a cause of action would accrue to the petitioners afresh to seek quashing of the FIR and the proceedings emanating therefrom. 3.

The petition is dismissed as not pressed.
