Issue notice. Mr. Kumar accepts notice on behalf of the nonapplicant/respondent. 2.

Learned counsel for the respondent says that he does not object to the prayer made in the application.

Learned counsel further says that he does not wish to file a reply. 4.

To be noted, the Director of the respondent company, i.e. Mr. Sanjoy Joshi is also present in Court.

Learned counsel for the petitioner says that the parties have settled their disputes. The prayer made in the application is as follows: "a) allow the Petitioner to withdraw the present Petition subject to the encashment of the 13 post-dated cheques amounting to Rs. 38,50,000/- with liberty to seek revival of the ARB.P. 230/2018

Petition in case the Respondent Company fails to honour its commitments under the settlement as recorded in the affidavits dated 20.06.2018 of Mr. Sanjay Joshi."

Accordingly, the prayer is allowed.

Parties undertake to adhere to the settlement arrived at between them.

The application is disposed of in the aforesaid terms. ARB.P. 230/2018 & I.A. Nos.8297-98/2018 9.
