% 20.09.2019 CM APPL.No.42238/2019 This application is filed by the appellant for release of the amount so deposited before this Court vide the order dated 23.03.2018 at the time of grant of stay of the judgment dated 05.02.2018 passed in CS No.2686/2016. It is stated by the learned counsel for the appellant the matter has been settled between the parties on 07.08.2019 and accordingly the appellant was to pay an amount of Rs.5,00,000/- only to the respondent/plaintiff for settlement of all disputes pending between them and an amount of Rs.1,60,000/- has already been paid per demand draft dated 13.09.2019 and the balance amount of Rs.3,40,000/- is lying deposited in this Court. It is stated the said amount of Rs.3,40,000/- be released in favour of the respondent/plaintiff and the interest accrued on the FDR so deposited on 24.04.2018 may be released in

favour of the appellant.

The registry is directed to encash the FDR of Rs.3,40,000/- and to pay Rs.3,40,000/- to the respondent/plaintiff and the interest accrued thereupon till date to the appellant herein. The application stands disposed of.
