By way of these petitions, the petitioners seek quashing of two FIRs, i.e. FIR bearing no. 0002/2023, registered at Police Station Mayapuri, New Delhi, for the commission of offence punishable under Sections 308/323/341/34 of the Indian Penal Code, 1860 (hereafter 'IPC') and FIR bearing no. 01/2023, registered at Police Station Mayapuri, New Delhi, for the commission of offence punishable under Sections 279/341/323/427/34 of IPC.

The petitioners and respondent nos. 2 and 3 in both the FIRs are present before this Court and have been identified by their counsels and concerned Investigating Officer (IO) from Police Station Mayapuri, New Delhi.

Briefly stated, facts of the present case are that the allegations in the aforementioned FIRs, arise out of an altercation had taken place during the road-rage between the parties, and subsequent to which cross FIRs were registered on the respective complaints against the petitioners under the relevant sections. However, it is stated that both the parties have amicably settled the present matter vide Memorandum of Understanding dated 08.11.2024, entered between them.

On a query made by this Court, respondent nos. 2 and 3/complainant in both the FIRs, who have been identified by the concerned IO, have categorically stated that they have entered into compromise out of their own free will and without any pressure, coercion or threat. It is also stated by them that the entire dispute has been amicably settled between the parties and they have no objection if these cross FIRs are quashed. In view of the above fact that the parties have amicably resolved their differences out of their own free will, without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIRs and the proceedings pursuant thereto. There is no legal impediment in quashing the FIRs in question. 6.

Accordingly, FIR bearing No. 0002/2023, registered at Police Station Mayapuri, New Delhi, for the commission of offence punishable under Sections 308/323/341/34 of IPC and FIR bearing no. 01/2023, registered at Police Station Mayapuri, New Delhi, for the commission of offence punishable under Sections 279/341/323/427/34 of IPC and all consequential proceedings emanating therefrom are quashed.

In view of the above, the present petitions, along with pending applications, stand disposed of.
