After some arguments, learned counsel for the appellant seeks leave to withdraw the present appeal which has been returned to the appellant/ plaintiff under Order VII Rule 10, CPC by the learned Trial Court with liberty to present the same before the Competent Court at Una, Himachal Pradesh in accordance with the directions issued in the impugned judgment. 2.

The appeal, alongwith the pending application, is accordingly dismissed as withdrawn.

Needless to say, this Court has not expressed any opinion on the merits of the appeal.
