This is one of batch of cases in which the Tribunal directed remedical examination, following its earlier decision in Teekaram Singh Meena v SSC1.

We have dealt with similar cases and laid down principles in which a fresh medical examination can be directed, in our decisions in Staff Selection Commission v Aman Singh2 and Staff Selection Commission v Amit Goswami 3.

We find that the Tribunal has not specifically adverted to the facts of the present case in the light of the said principles. 4.

Accordingly, with consent of parties, the impugned order is quashed and set aside.

The OA stands remanded to the Tribunal for de novo consideration in accordance with law, keeping in mind the principles laid down in Aman Singh and Amit Goswami.

6.

Let both the parties appear before the Tribunal on 10 December 2024.
