By way of the present application, the applicant seeks interim bail in case arising out of FIR bearing no. 41/2025, registered at Police Station Samaypur Badli, Delhi for the commission of offences punishable under Section 103(1) of the Bharatiya Nyaya Sanhita, 2023 (hereafter 'BNS'), for a period of one month on the ground that the mother of the applicant has to undergo surgery.

The learned APP for the State has relied on the Status Report filed before the learned Trial Court wherein the factum of surgery of the mother of the applicant had been verified. The learned counsel appearing for the applicant states, at bar, that surgery of the applicant's mother is scheduled for 21.11.2025. The learned counsel for the applicant draws this Court's attention to the prescription of the doctor concerned wherein it is mentioned that date of admission is 20.11.2025 and the date of surgery is scheduled for 21.11.2025. It is, therefore, prayed that the applicant be released on interim bail a week prior to the date of surgery.

Considering the overall facts and circumstances of the present case, this Court is inclined to grant interim bail to the applicant herein with effect from 13.11.2025 with a direction to surrender on 15.12.2025, on his furnishing personal bond in the sum of Rs.10,000/- with one surety of the like amount, subject to the satisfaction of the learned Trial Court/Successor Court/Link Court/Duty Judge concerned on the following terms and conditions:

i) The applicant shall not leave the country without prior permission of the concerned Court and if the applicant has a passport, he shall surrender the same to the concerned trial court. ii) In case of change of residential address/contact details, the applicant shall promptly inform the same to the concerned Court and IO/SHO concerned.

iii) The applicant shall appear regularly before the learned Trial Court, unless exempted.
