By way of the present application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the applicant seeks regular bail in connection with FIR No. 241/2024 dated 30.04.2024, registered at Police Station Harsh Vihar, under Sections 307 and 34 of the Indian Penal Code, 1860, as well as Sections 25, 27, 54 and 59 of the Arms Act, 1959.

After some arguments, Ms. Santosh Dixit, learned counsel for the applicant, seeks permission to withdraw the present bail application, without prejudice to the applicant's right to file afresh before the learned Sessions Court after framing of charges and recording of the complainant's evidence. According to Mr. Yudhvir Singh Chauhan, learned Additional Public Prosecutor for the State, the complainant is the principal material witness in the case.

trial proceedings. It shall be open to the applicant to move an appropriate application before the learned Sessions Court, which may consider the same in accordance with law, having regard to the position of the Board and the age of the matters pending before it, particularly with regard to framing of charges and recording of the complainant's evidence. 4.

Mr. Chauhan and Mr. Virendra Kumar, learned counsel for the complainant, assure the Court that no unnecessary adjournments shall be sought by them before the learned Trial Court. 5.

The present bail application, alongwith the pending applications, is accordingly dismissed as withdrawn, in terms of the above submissions. 6.

It is clarified that this Court has not made any observation on the merits of the case, and all rights and contentions of the parties in any future application are left open.
