% 09.02.2026 CRL.M.A. 4273/2026 By way of the present application filed under section 379 of the Bharatiya Nagarik Suraksha Sanhita, 2023 read with sections 227/228/236/237/246 of the Bharatiya Nyaya Sanhita 2023, the applicants seek initiation of proceedings against the petitioner, purportedly claiming that the petitioner had wilfully made false statements and suppressed material facts from the court in the present proceedings i.e. W.P. (Crl.) No.3685/2024.

The applicants, who are the daughters of the petitioner, were not parties to the proceedings.

The allegations in the application seem to support the case of the applicants' father - Amit Wadhwa, who has been declared proclaimed offender and against whom extradition proceedings are pending in the United States.

Upon query, Ms. Payal Chawla, learned counsel appearing for the applicants submits, that the applicants have been constrained to move the present application since the facts narrated therein are exclusively to their knowledge.

Ms. Chawla also contends that the application is maintainable at the hands of the applicants.

Mr. Sujeet Kumar Choudhary, learned counsel is present on behalf of Mr. Jagdish Chandra, learned CGSC for the Union of India on advance copy; and submits that they have not been served with the copy of the application.

The father, in whose support the averments in the application appeared to be made, was not a party to the writ petition. 9.

Before proceeding further with the matter, let a copy of this application be furnished to the learned CGSC, who will take instructions and assist the court on the next date.

10. Re-notify on 23rd March 2026.

11. It is made clear that no notice has been issued on the application as of now.
