This is an Application filed on behalf of the Petitioner seeking extension of time in the mediation proceedings pending before the Mediation Centre, Saket District Court.

A Coordinate Bench of this Court by its order dated 26.11.2024 had directed that mediation be conducted at the Mediation Centre Saket, Delhi under Section 12A of the Commercial Courts Act, 2015 [hereinafter referred to as "Act"].

Learned Counsel for the Petitioner submits that Section 12A(3) of the Act contains a proviso for extension of time for a further period of two months with the consent of the parties.
3.1 Learned Counsel for the Petitioner further submits that the reason for delay is in view of the fact that the parties have to travel for the mediation from outside the city.

Issue Notice. Learned Counsel for the Respondents accept Notice and submit that they have no objection if the prayers made in the Application are allowed.

Accordingly and in view of the proviso to Section 12A(3) of the Act, the period of mediation is extended for a further period of 60 days with the consent of the parties.
5.1 The Secretary Mediation Centre, Saket shall ensure that the mediation is undertaken through video conferencing to enable the parties to adhere with the timelines as set out in the Act.

The Application is disposed of in the aforegoing terms. 7.
