O.M.P. (COMM) 109/2017 & IA Nos.2943-2944/2017 The petitioner has filed the present petition under 34 of the Arbitration and Conciliation Act, 1996 (hereafter 'the Act') impugning an award dated 23.05.2016. The petition has been filed with a delay of 192 days.
The petitioner has sought to explain the delay by stating that the process for taking a decision for filing the petition took a considerable period of time. This court is not persuaded by the explanation offered by the petitioner. Apart from that, in view of the express language of Section 34 of the Act, this Court has no jurisdiction to condone the delay beyond the period of 30 days from the specified period of three months.
The petition and all the pending applications are accordingly dismissed.
