Learned APP accepts notice for respondent no. 1.

Respondent no.

2 is represented through her mother Ms.

Suman.

Respondent no. 2 is now 17 years of age. She is present in Court along with her counsel and accepts notice. She has been identified by SI Ranbir Singh of police station Nangloi.

Respondent no.2 alleged in the FIR that petitioner touched her breast. It is submitted that respondent no. 2 through her mother has settled the matter with the petitioner of her own free will and without any undue force, pressure or coercion.

Therefore, FIR No. 24/2016 under Sections

354/354(A) IPC and Section 12 of the POCSO Act and the consequent proceedings emanating therefrom may be quashed. Respondent no. 2 is present in Court along with her mother. Both of them say that matter has been amicably settled, inasmuch as petitioner has compensated them by paying `25,000/- towards mental pain and agony suffered by her. Therefore, they have no objection in case aforesaid FIR and the consequent proceedings emanating therefrom are quashed.

Keeping in mind the settlement arrived at between the petitioner and respondent no. 2 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms. Dasti. A.K. PATHAK, J.
