% 05.02.2019 CM.APPL. 19624/2018 This is an application filed by applicant/appellant seeking condonation of 27 days delay in filing the appeal. For the reasons stated in the application, the delay in filing appeal is condoned.

The application stands disposed of.

RFA(OS) 29/2018 By the present appeal, the appellant has made a prayer to allow the appeal and set aside the judgment/order of this court dated 17.01.2018 and decree passed by the learned Single Judge in CS (OS) No.1046/2012 titled as 'Tata Sons Limited vs. Mohammad Zafir & Ors' and award nominal

damages and counsels' fee of Rs.8500/- (Rupees Eight Thousand Five Hundred only).

This matter has been adjourned from time to time to enable the parties to arrive at an amicable resolution with regard to payment of cost awarded by the learned Single Judge. Parties have arrived at an amicable settlement. It is prayed that the appeal be disposed of in terms of the settlement. It is agreed and undertaken by the appellant that he would pay a sum of Rs.2,00,000/- to the respondent within three months from today. On payment of the said amount, the decree would stand satisfied and a satisfaction letter would be issued by the respondent to the appellant. Needless to mention, if the amount is not paid, it would be open for the respondent to execute the decree.

In view of the settlement arrived at, the appeal is disposed of, as not pressed.

We make it clear that in case sum of Rs.2,00,000/- is paid within three months, the decree would stand satisfied.

The payment shall be made in the name of Tata Sons Pvt. Ltd. G.S.SISTANI, J JYOTI SINGH, J FEBRUARY 05, 2019 ssc RFA(OS) 29/2018
