This writ petition is filed on behalf of the Petitioner under Articles 226/227 of the Constitution of India seeking the following reliefs:- "(1) Issue a writ in the nature of Mandamus Quashing the respondent no.1's EAuction notice as per notice dt.20.09.2025, REF NO. CB/SAR/BB/13-2/(86)SEPT/2025/09,to the respondent no.2, 3 and 4 with regard to the secured asset i.e. WZ-49-A, (PLOT NO.-27), including roof built on land measuring 260 Sq. Yards. Out of Khasra no. Rectangle No.-6/12 Kila Portion and Khasra No.-12/7/1 and 12/4 portion situated in the area of Village Choukhandi, Shyama Prashad Mukherjee Park, New Delhi-110018 till the 1/3rd share of the petitioner is not determined and released in favour of the petitioner.
(2) Issue a writ in the nature of Mandamus directing the respondent no. 1 to suspend any further action on the E-Auction notice dt.20.09.2025 REF NO. CB/SAR/BB/13-2/(8- 6)SEPT/2025/09 till pending the petition of the petitioner.
(3) Issue a writ in the nature of Mandamus directing the respondent no.1 to release the 1/3rd share of the petitioner in the secured asset i.e.WZ-49-A, (PLOT NO.-27), including roof built on land measuring 260 Sq. After canvassing some arguments, learned counsel for the Petitioner, on instructions, seeks to withdraw this writ petition with liberty to take recourse to appropriate remedies.

Writ petition along with the pending application is disposed of as withdrawn with liberty as prayed for.

It is made clear that this Court has not expressed any opinion on the merits of the case.
